PREAMBLE

These general terms and conditions of sale (GTC) are concluded between:

On one hand:

MISS JUNE PARIS - BROD'STYL INTERNATIONAL SAS, registered under SIRET number 42125872400028, with its head office at 41, rue du Caire, 75002 Paris, hereinafter referred to as "MISS JUNE PARIS,"

On the other hand:

Any individual wishing to make purchases for personal purposes through the websites www.miss-june.com or www.miss-june.us will hereinafter be referred to as the "User" or "Client."

The User declares having read these GTC before any order of products or services. Any order implies full acceptance of the GTC. These take precedence over any other version or contradictory documents.

ARTICLE 1 – SCOPE OF APPLICATION

These GTC define the contractual relationship between MISS JUNE PARIS and the User, as well as the conditions applicable to any purchase made on the MISS JUNE PARIS online store websites www.miss-june.com or www.miss-june.us (hereinafter referred to as the "Site").

The User agrees to use the Site for strictly personal and non-commercial purposes. Any resale is prohibited under Article L 110-1 of the Commercial Code.

Access to the Site is reserved for persons aged at least 18 years with legal capacity or parental authorization.

MISS JUNE PARIS reserves the right to modify these GTC at any time. The applicable GTC are those in effect on the date of the order.

ARTICLE 2 – PRODUCTS

The main characteristics of the products are detailed on the descriptive sheets available on the Site. The User is informed that the photographs, images, and colors of the products presented may slightly differ from the actual shades due to screen or browser settings.

Products are offered within the limits of available stocks.

ARTICLE 3 – PRICES

Product prices are indicated in euros, including all taxes (VAT included). They do not include processing, packaging, and delivery costs, specified before order validation.

In the event of changes in taxes, including VAT, these changes may be reflected in the product prices.

MISS JUNE PARIS reserves the right to modify prices at any time. However, the prices applicable will be those in effect on the date of order validation.

The data recorded by the Site serve as proof of transactions, as do those recorded by the payment system for financial transactions.

ARTICLE 4 – ORDER

4.1 Order Process

The User can place an order in two ways:

  • Online, by accessing the Site’s catalog.
  • By phone, using references available in printed or online catalogs.

It is necessary to register on the Site to complete an order. During this registration, the User can choose to order either as a guest or by creating an account. The credentials are strictly personal, and in case of loss or forgetting, the User must contact Customer Service for assistance.

Any order constitutes acceptance of the products' prices and descriptions.

4.2 Product Availability

MISS JUNE PARIS undertakes to fulfill orders within the limits of available stocks. In case of unavailability, a solution (replacement, cancellation, or refund) will be proposed.

In certain cases, such as non-payment, incorrect address, or other issues with the user's account, MISS JUNE PARIS reserves the right to block the user's order until the issue is resolved.

ARTICLE 5 – PAYMENT

5.1 Accepted Payment Methods

Secure Payment via SYSTEM PAY BANQUE POPULAIRE

Bank Cards: CB, Mastercard, American Express. We use the SYSTEM PAY solution from Banque Populaire to ensure the security of your payments. All transactions made using this solution are conducted in a secure space with SSL technology and are guaranteed by the 3D Secure system. At no point are your banking details stored on our website, ensuring that we never have access to or knowledge of them.

Payment via PayPal

PayPal: PayPal is a reliable and secure method for making online purchases. You have the option to use PayPal as a trusted third party to settle your orders by bank card without the need to have a PayPal account. Additionally, if you have a PayPal account, you can make payments using your PayPal balance. By choosing the PayPal payment option, you will be automatically redirected to their platform to complete the payment. Once your PayPal transaction is confirmed, you will be redirected back to the miss-june.com site to finalize your order.

Payment with Alma

Alma: Alma offers you the possibility to pay for your purchases in installments simply and securely, available throughout the European Union. You can choose to split your payment into 2, 3, or 4 installments, thereby facilitating a more flexible management of your budget. This solution is designed to offer you comfort and peace of mind during your transactions.

Payment via Stripe

Stripe: Stripe is a secure solution that allows us to offer a variety of modern and reliable payment options. With Stripe, you can use innovative payment methods like Apple Pay and Google Pay (GPay) for a smooth and quick shopping experience. This service guarantees secure processing of your transactions while providing you with the flexibility and convenience necessary to make your purchases with ease.

5.2 Failed or Suspected Fraudulent Payment

In the event of a failed payment, the order will be automatically canceled and the items will be returned to stock. MISS JUNE PARIS reserves the right to suspend any transaction if fraud or unauthorized payment is suspected. Any fraudulent use of a payment method may be reported to the relevant authorities. Moreover, MISS JUNE PARIS reserves the right to restrict or block access to the relevant user's account for the time needed to resolve the issue. This procedure is intended to ensure the security of your transactions and to maintain trust between our clients and us.

ARTICLE 6 – DELIVERY

6.1 Delivery Providers

The delivery of your orders is usually handled by Colissimo - La Poste. However, we reserve the right to change the provider without notice. Delivery or shipping fees will be communicated to you at the time of ordering and apply only to the products ordered. These fees correspond to the rates usually charged by the delivery provider. To ensure moderate delivery costs, MISS JUNE PARIS covers part of the expenses. 6.2 Delivery Times and Charges

  • Standard: Colissimo Service €7.00 - Free shipping for orders over €150 (delivery time: 3 to 5 days).
  • Express: DHL Service within 72 hours (€12).
  • Free returns for purchases over €150 (excluding promotional periods).

United Arab Emirates, Kuwait, Qatar, Saudi Arabia, Bahrain:

  • Shipping: Exclusively via DHL with a delivery time of 5 to 12 days. Shipping cost: €34.95.
  • Free shipping on orders over €300.
  • Return costs are the responsibility of the customer.

Other Destinations:

  • (Saint-Martin, St Barth, Mauritius, Maldives, New Caledonia, French Polynesia, Puerto Rico)

  • Standard Shipping: Exclusively via DHL with a delivery time of 5 to 12 days. Shipping cost: €34.95.

  • Return costs are the responsibility of the customer.

6.3 Exceptional Periods

During exceptional periods, such as strikes, natural disasters, health crises, or other unforeseen events, delivery times may be extended beyond the control of MISS JUNE PARIS. These circumstances may also lead to restrictions on certain delivery methods or cause unexpected delays.

6.4 Customs Fees

For orders shipped outside the European Union, customs fees or other local taxes (VAT, import duties, etc.) may be required by the local authorities of the destination country. These fees are to be borne exclusively by the User and are their responsibility. MISS JUNE PARIS is not obliged to inform the User about the applicable fees or taxes in their country. We recommend that the User consults the competent authorities before finalizing the order.

ARTICLE 7 – RETURN AND RIGHT OF WITHDRAWAL

7.1 Right of Withdrawal

In accordance with Article L221-18 of the Consumer Code, the User has a 15-day period (or 30 days for Australia) from the receipt of the product to exercise their right of withdrawal. 7.2 Return Conditions

To be accepted, returns must:

  • Be returned in their new condition, complete, with original tags and accessories.
  • Not have been worn, washed, or damaged.

Any product not meeting these conditions will be refused.

Return costs for orders made during promotional periods are fully the responsibility of the customer.

The User must:

  • Include the completed return form, contain RETURNS
  • The order number (9 letters),
  • Name and surname,
  • Reason for the return. Send the items in their original packaging (or in suitable packaging that ensures protection of the product).

7.3 Refund Conditions

The refund will be processed between 5 and 10 working days after the return is received and validated at our warehouses.

The refund will be made via the same payment method used for the order.

MISS JUNE PARIS will notify the User by email once the return is received and accepted. Return costs remain the responsibility of the customer unless otherwise stated (e.g., free returns for orders over €150 in France or €200 in the European Union, excluding promotional periods).

ARTICLE 8 – GUARANTEES

All items are subject to a legal guarantee of conformity (Article L211-1 of the Consumer Code) and a guarantee against hidden defects (Articles 1641 and following of the Civil Code) allowing the return of defective delivered items. Except in the case of a legal guarantee, any operation between MISS JUNE PARIS and users, not contested within 3 months, cannot give rise to a complaint.

Some items also benefit from contractual guarantees superior to the legal guarantee, such as specific textiles with a specific mention.

Article L211-4 of the Consumer Code: The seller is required to deliver a good in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from packaging, assembly instructions, or installation when this is charged to them by the contract or carried out under their responsibility.

Article L211-5 of the Consumer Code: To be in conformity with the contract, the good must:

  1. Be fit for the usual purpose of a similar good and, where applicable:- Correspond to the description given by the seller and have the characteristics that the seller has presented to the buyer in the form of a sample or model;- Have the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer, or their representative, particularly in advertising or labeling;

  2. Or have the characteristics defined by mutual agreement by the parties or be suitable for any special use sought by the buyer, made known to the seller and accepted by them.

Article L211-12 of the Consumer Code: The action resulting from the lack of conformity is barred after two years from the delivery of the goods.

Article 1641 of the Civil Code: The seller is liable for the warranty due to hidden defects of the item sold which render it unfit for its intended use, or which so diminish its use that the buyer would not have acquired it, or would only have given a lower price for it, if he had known them.

Article 1648 al 1 of the Civil Code: The action resulting from redhibitory defects must be brought by the purchaser within two years from the discovery of the defect.

ARTICLE 9 – DATA PROTECTION

MISS JUNE PARIS reserves the right to collect data about the user, specifically through the use of cookies. The data collection by MISS JUNE, as the data controller, is necessary for processing the user's requests.

By providing their email to MISS JUNE, the user can receive an order confirmation. Depending on the choice made during the creation or consultation of their account, the user may receive offers from MISS JUNE PARIS and commercial partners by mail, phone, or SMS, as indicated during account creation.

It is our responsibility to ensure the personal data we hold is correct.

In accordance with the General Data Protection Regulation (GDPR), the user has the right to access, modify, rectify, and delete personal data concerning them.

ARTICLE 10 – INTELLECTUAL PROPERTY

All elements of the MISS JUNE PARIS website, whether visual or auditory, including the underlying technology, are protected by copyright, trademark, or patent laws.

Therefore, no documents from the MISS JUNE PARIS site may be copied, reproduced, published, downloaded, posted, transmitted, or distributed in any way, except under the following conditions: a copy of the documents may be downloaded onto a computer for personal, non-commercial use, provided that you do not modify the information and that you keep all copyright and other proprietary notices intact. Modifying these documents or using them for another purpose constitutes an infringement of MISS JUNE's intellectual property rights.

Any user with a personal website who wishes to place a simple link on their site that directs to the homepage of the MISS JUNE site must obtain explicit authorization from MISS JUNE. This will not, under any circumstances, imply an affiliation agreement.

However, any hyperlink leading to the MISS JUNE PARIS site and using framing or in-line linking techniques is strictly prohibited. In any case, any link must be removed upon simple request by BROD'STYL INTERNATIONAL SAS | MISS JUNE PARIS. The trademarks, logos, designs, and models appearing on this site are the exclusive property of MISS JUNE Paris. Their disclosure should not, under any circumstances, be interpreted as granting a license or any rights to use said trademarks and distinguishing features protected by copyright. ARTICLE 11 – COMMERCIAL OFFERS

MISS JUNE may send Users commercial offers by mail, email, SMS, phone, or through any of the web spaces managed by MISS JUNE PARIS or any of its subsidiaries on social media, subject to prior consent.

ARTICLE 12 – APPLICABLE LAW

12.1 Duration

These conditions apply throughout the online availability of services offered by MISS JUNE.

Proof, preservation, and archiving of transactions

Computerized records, maintained in the computer systems of MISS JUNE PARIS and its partners under reasonable security conditions, will be considered proof of communications, orders, and payments that have occurred between the parties.

The archiving of order forms and invoices is carried out on a reliable and durable medium so as to constitute a faithful and durable copy in accordance with Article 1348 of the Civil Code.

12.2 Applicable Law and Consequences

These conditions are subject to French law. The competent court in the event of a dispute will be that of the defendant's domicile or, at the plaintiff’s choice, the place of actual delivery of the product.

This site complies with French legislation, and under no circumstances does MISS JUNE PARIS guarantee compliance with the local legislation that would be applicable to you, especially if you access the site from other countries.
